# Terms and Conditions The terms you agree to when you use Karigarh or place an order. ## Introduction **Karigarh** — Jaipur **Last updated: 11 October 2026** These Terms and Conditions ("Terms") govern your access to and use of the website, mobile site, and services of **Karigarh** (the "Platform"), owned and operated by **E-New Bharat Services Pvt. Ltd.**, a company incorporated in India with its registered office at **301-303, Suncity Trade Tower, Sector 21, Gurugram, Haryana 122016** ("Karigarh", "we", "us", "our"). This document is an electronic record under the Information Technology Act, 2000 and the rules made thereunder, and is published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020. It does not require any physical or digital signature. **By accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and our Return, Refund & Cancellation Policy (together, the "Platform Policies"). If you do not agree, please do not use the Platform.** ## 1. About the Platform Karigarh is an online marketplace for authentic Indian handicrafts, handlooms, and heritage products, including **ODOP (One District One Product)** and **GI (Geographical Indication)-tagged** items, sourced from artisans, craft clusters, and verified sellers across India. Products may be sold by us directly and/or by third-party sellers listed on the Platform; the seller of each product is identified on the product/invoice as required by law. ## 2. Eligibility - You must be at least **18 years of age** and competent to contract under the Indian Contract Act, 1872 to register, transact, or purchase on the Platform. - Persons under 18 may use the Platform only through and under the supervision of a parent or legal guardian, who will be responsible for such use. - By using the Platform you represent that all information you provide is true, accurate, current, and complete. ## 3. Account Registration and Responsibilities - Certain features require you to create an account with a valid email address and/or mobile number. - You are responsible for maintaining the confidentiality of your login credentials and for **all activities under your account**. Notify us immediately at support@enewbharat.com of any unauthorised use. - You agree to keep your account information (including delivery addresses and contact details) accurate and up to date. - You may not create accounts using false identities, impersonate another person, or operate multiple accounts for abusive purposes. - We may suspend or terminate accounts that violate these Terms, applicable law, or are associated with fraudulent, abusive, or suspicious activity. ## 4. Product Listings, Accuracy, and the Handmade Disclaimer - We endeavour to describe and photograph every product accurately, including material, dimensions, weight, craft technique, artisan/cluster origin, **country of origin (India, with district/state of craft origin where applicable)**, and price, in line with the Consumer Protection (E-Commerce) Rules, 2020 and the Legal Metrology (Packaged Commodities) Rules, 2011. - **Handmade disclaimer:** our products are handcrafted. Minor variations in colour, shade, texture, weave, finish, motif, and size relative to the product images or between individual pieces are **inherent to handmade goods and are not defects**. Screen settings may also cause colour differences. Such variations do not constitute a listing inaccuracy or deficiency in service. - **GI and ODOP authenticity:** products described as GI-tagged are sourced from authorised producers/artisans within the relevant GI-registered region, and products described as ODOP originate from the notified district for that product. Where provided, GI labels/certificates accompany the product. These statements relate to origin and craft authenticity and are made to the best of our knowledge based on seller/artisan declarations and available documentation. - Product availability is not guaranteed; handcrafted items are often produced in small or one-of-a-kind lots. Made-to-order items carry the crafting/dispatch timelines stated on their product pages, which are estimates. - In case of an error in listing, description, or pricing, we reserve the right to correct the error and to cancel affected orders with a full refund (see Section 6). ## 5. Pricing, Taxes, and Payments - All prices are displayed in **Indian Rupees (INR)** and, unless stated otherwise, are **inclusive of GST** and other applicable taxes. Shipping charges, if any, are shown separately at checkout before payment. - A tax invoice compliant with GST law will be issued for every order. - Prices may change without notice, but changes will not affect orders already accepted. - Payments are processed by **Razorpay**, our authorised payment gateway, supporting cards, UPI, net banking, and wallets. **We do not collect or store your card or banking credentials**; these are handled by Razorpay under its own terms and privacy policy. You agree not to use payment instruments that do not belong to you or that you are not authorised to use. - If Cash on Delivery is offered, it may be subject to order-value limits and serviceability. ## 6. Orders, Acceptance, and Cancellation - Your order is an **offer to purchase**. Our acknowledgement of the order (order confirmation email/SMS) does not by itself constitute acceptance; a binding contract for a product arises **upon dispatch** of that product to you. - We may refuse or cancel any order (in whole or in part), before dispatch, for reasons including product unavailability, pricing/listing errors, non-serviceable delivery locations, suspected fraud or abuse, bulk/resale ordering patterns, or failure of payment authorisation. In all such cases any amount paid will be refunded in full to the original payment method. - Customer cancellation is governed by our Return, Refund & Cancellation Policy (free cancellation before dispatch; made-to-order items cancellable only within 24 hours of ordering). ## 7. Shipping and Delivery - We ship **within India only**. We do not currently accept orders for delivery outside India. - Estimated dispatch and delivery timelines are shown on product pages/checkout and are **estimates, not guarantees**. Handcrafted and made-to-order items may need longer crafting times, which will be indicated. - Delivery is made through third-party logistics partners to the address you provide. Please ensure the address and contact number are accurate; we are not responsible for delays or non-delivery due to incorrect or incomplete address details, or recipient unavailability after reasonable attempts. - Risk in the products passes to you upon delivery. Title passes upon delivery, subject to receipt of full payment. - Fragile items (pottery, glass, marble, papier-mâché, etc.) are specially packed. Please follow the unboxing-video guidance in our Return, Refund & Cancellation Policy to preserve your transit-damage claim rights. - If a shipment is returned to us undelivered (RTO) after reasonable delivery attempts, we will contact you for re-dispatch (re-shipping charges may apply) or issue a refund of the product price. ## 8. Returns, Refunds, and Grievances Returns, exchanges, refunds, damage claims, and cancellations are governed by our **Return, Refund & Cancellation Policy**, which forms an integral part of these Terms. In summary: 7-day return window from delivery for eligible items; 48-hour window for transit-damage claims with photos/unboxing video; refunds to the original payment method via Razorpay, typically credited within 7–10 business days of initiation. ## 9. Intellectual Property - All content on the Platform — including the "Karigarh" name and logo, text, graphics, product photographs, artisan stories, videos, designs, software, and compilations — is owned by or licensed to E-New Bharat Services Pvt. Ltd. and is protected under Indian copyright, trademark, and other intellectual-property laws. - You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial shopping purposes. You may not copy, reproduce, scrape, republish, distribute, or create derivative works from Platform content without our prior written consent. - Geographical Indications, craft names, and artisan works referenced on the Platform belong to their respective registered proprietors, authorised users, and creators. Nothing on the Platform grants you any right to use them. - By submitting reviews, photographs, or other content to the Platform, you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, display, and reproduce such content in connection with the Platform, and you confirm the content is your own and does not infringe any third-party rights. ## 10. Prohibited Use You agree not to: - use the Platform for any unlawful, fraudulent, or unauthorised purpose; - buy products for the purpose of counterfeiting, misrepresenting origin, or passing off non-genuine items as GI-tagged or artisan-made; - post or transmit content that is defamatory, obscene, hateful, infringing, misleading, or otherwise objectionable under Rule 3(1)(b) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021; - introduce viruses or malicious code, or attempt to gain unauthorised access to the Platform, other accounts, or our systems; - use robots, spiders, scrapers, or other automated means to access or copy the Platform or its content; - interfere with or disrupt the Platform's operation or place unreasonable load on our infrastructure; - post fake or manipulated reviews, or misuse offers, coupons, or referral programmes; or - resell products purchased from the Platform in a manner that misrepresents their origin or authenticity. Violation may result in suspension or termination of access, cancellation of orders, forfeiture of promotional benefits, and reporting to law-enforcement authorities. ## 11. Disclaimers and Limitation of Liability - The Platform and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, other than those that cannot be excluded under applicable consumer-protection law. Nothing in these Terms limits your statutory rights under the Consumer Protection Act, 2019. - We do not warrant uninterrupted, error-free, or secure operation of the Platform. - Handmade variations described in Section 4.2 do not constitute defects, deficiencies, or misrepresentations. - To the maximum extent permitted by law, our aggregate liability arising out of or in connection with any order shall not exceed the **amount paid by you for that order**, and we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. - We are not liable for delays or failures caused by events beyond our reasonable control (force majeure), including natural disasters, epidemics, strikes, transport disruptions, governmental actions, or failures of telecom/internet or logistics networks; our obligations stand suspended for the duration of such events. ## 12. Indemnity You agree to indemnify, defend, and hold harmless E-New Bharat Services Pvt. Ltd., its directors, officers, employees, artisan/seller partners, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms or the Platform Policies; (b) your violation of any law or third-party rights; (c) content you submit to the Platform; or (d) your misuse of the Platform. ## 13. Governing Law and Jurisdiction These Terms and all transactions on the Platform are governed by and construed in accordance with the **laws of India**. Subject to any mandatory provisions of the Consumer Protection Act, 2019 regarding consumer forums, the courts at **[JURISDICTION CITY]**, India shall have exclusive jurisdiction over all disputes arising out of or in connection with these Terms or the Platform. ## 14. Miscellaneous - **Severability:** if any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. - **Waiver:** our failure to enforce any provision is not a waiver of that provision. - **Assignment:** you may not assign your rights under these Terms; we may assign ours in connection with a merger, acquisition, or sale of assets. - **Entire agreement:** these Terms, together with the Privacy Policy and the Return, Refund & Cancellation Policy, constitute the entire agreement between you and us regarding the Platform. - **Communications:** you consent to receive transactional communications from us electronically (email/SMS/WhatsApp) at the contact details you provide. ## 16. Changes to These Terms We may revise these Terms at any time by posting the updated version on this page with a revised "Last updated" date. Material changes will be notified through the Platform or by email. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
